1.     SUMMARY

1.1.           When you use Cocolime, you trust us with your information. Cocolime is committed to retaining your trust and safeguarding your privacy. Our commitment starts with helping you understand our privacy practices.

1.2.           This privacy policy (the “Privacy Policy”) explains what information we collect, how we use and share it, how long we retain it, and what choices you have regarding this information.

1.3.           By visiting Cocolime, you acknowledge that you have read and understood this Privacy Policy and agree to the collection and use of your information in accordance with its terms. If you do not agree, please discontinue use of our services.

2.     DATA COLLECTION AND USE

2.1.           This Privacy Policy describes how Cocolime, together with its affiliates and authorized service providers, collects, uses, discloses and protects personal information in connection with the provision of our Services.

2.2.           This Privacy Policy applies to:

-        All users of Cocolime’s services worldwide, including users of Cocolime’s apps, websites, tools, features, products or other services (collectively the “Services”), regardless of the method of access (including through mobile devices), unless covered by a separate privacy policy that expressly supersedes this one.

-        Consumers – i.e. individuals who access Cocolime and/or who purchase products on the Cocolime application.

-        Representatives – i.e. individuals who deliver products/services purchased on the Cocolime application, whether directly or through partner courier companies.

-        Those who provide information to Cocolime in connection with an application to use our Services, and/or those whose information is provided to or otherwise received in connection with our Services (such as contact information of individuals associated with Cocolime partners).

All individuals subject to this Privacy Policy are referred to collectively as “Users.”

3.     DATA CONTROLLER

3.1.            Cocolime provides services to Users throughout the world. If you use our Services in the Kingdom of Saudi Arabia, Care and More LLC is the data controller of your information.

3.2.           If you live in the Kingdom of Saudi Arabia, the data controller of the information you provide or that is collected by Cocolime or its affiliates is:

3.3.           If you live outside the Kingdom of Saudi Arabia, the controller of your personal information is the registered local entity in the country in which you use our services. 

3.4.           We, along with our affiliates and authorized service providers may collect information that you provide directly via the application, and/or other websites operated by us, or  that we obtain through your interactions with our customer service channels, including:

-        Information provided when you use our applications, websites, or other online platforms;

-        Information shared during communications with our customer service team, whether by phone, email, live chat, social media, or other channels;

-        Details submitted when you register an account, participate in promotions or surveys, or subscribe to marketing communications; and

-        Information obtained from third parties authorized to share your data with us.

3.5.           We, along with our affiliates and authorized service providers may collect information even if you are not a registered User on Cocolime or do not place an order.

3.6.           We process personal information both inside and outside of the Kingdom of Saudi Arabia. In all cases, and including where data is transferred outside the Kingdom, such transfers are made in accordance with applicable data protection laws and regulations.

4.     THE INFORMATION WE COLLECT

Cocolime together with its affiliates and authorized service providers, collects and processes information from and about users in connection with the provision and improvement of its Services. We collect the following information:

a)     Any information/details that you provide to Cocolime, such as when you create your Cocolime account, complete a transaction, contact customer support, or otherwise interact with us.

b)     Any contact and personal details such as your name, delivery address, phone number, email address, billing and payment information, date of birth, gift recipient details, gender, nationality and personal shopping preferences.

c)     Any information created when you use our Services, such as location, usage and device information, your name, email, phone number, login name and password, address, payment or banking information (including related payment verification information), government identification numbers, date of birth, photo and signature.

d)     Any website statistical information such as usage and device information, including your location, the URL you use to access the application, website, browser or device type/unique fingerprint, your computer’s IP address and domain type, device ID or unique fingerprint, cookie information and similar technology, pages you visited, products you viewed search terms you entered, items you clicked on,  time spent, operating system, browser type, language settings, and access times.

e)     Any information from other sources, such as Cocolime representatives and third parties that use Cocolime APIs such as couriers, payment providers, analytics vendors, and marketing affiliates.

f)      Any transactional information such as orders you placed, items you purchased, date and time of your order, payment details (including payment verification information), orders you decided not to complete or items you placed in your basket and discarded, preferences you have indicated to us, requested personalization of items, saved items, and purchase history.

g)     Any information you supply to us via online or offline surveys, competitions, product registration or marketing subscriptions.

h)     Any background check information if you sign up to use Cocolime services as a representative. This may include information such as your driving history, identity verification results, or criminal record (where permitted by law).

i)      Any demographic information about you, including through user surveys and analytics. This may include information such as access dates and times, app features or pages viewed, application crashes and other system activity, type of browser and third-party sites or service you were using before interacting with our Services. In some cases, this information is collected automatically through cookies, pixel tags, and similar technologies that create and maintain unique identifiers.

j)      Any information about the devices you use to access our Services, including the hardware models, device IP address, operating systems and versions, software, file names and versions, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion information, and mobile network information.

k)     We enable users to communicate with each other and Cocolime through Cocolime application, websites and other communication channels/services. For example, representatives and consumers may call or text each other (in some jurisdictions, without disclosing their telephone numbers to each other). To provide this functionality, Cocolime may receive and process some information regarding such calls or texts, including the date, time, duration and content of the call/text, and as well as technical data necessary to deliver the communication.

l)      Where you provide the information of a third party to us, you are confirming that you have obtained their prior consent or that you are otherwise legally entitled to share such information.

5.     SENSITIVE PERSONAL DATA

Data protection laws classify certain categories of personal information, such as an individual’s ethnic or tribal origin, religious beliefs, criminal history, and health information, as “sensitive data”, which require enhanced safeguards and stricter handling procedures.

We do not anticipate processing any of your sensitive data unless it becomes necessary for the purposes of our dealings with you, or unless you voluntarily choose to provide such information. Examples of situations where sensitive data may become relevant include where a medical condition is relevant to our engagement or communications with you; where such information is necessary to address a legal claim, dispute, or complaint; or where the information relates to criminal conduct affecting our business.

In the limited circumstances where we may need to handle sensitive data, we will only do so strictly in accordance with, and as permitted by, applicable law, ensuring all appropriate safeguards are applied.

6.     HOW WE USE YOUR INFORMATION

Cocolime collects and uses information to enable the reliable, secure and convenient provision of our Services, including the purchase, delivery and other products and services. We also use the information we collect for the following purposes mainly:

       i.         Providing services and features

Cocolime uses the information we collect to provide, personalize, maintain and improve our products and services. This includes for example:

-        Create and update your account.

-        Verify your identity.

-        Enable, process and fulfill purchases, orders, deliveries and other services.

-        Verify, process and/or facilitate payments for those services, including procuring credit checks or performing fraud detection.

-        Offer, obtain, provide and/or facilitate insurance or finance solutions in connection with our services.

-        Track the progress of your delivery

-        Enable features that allow you to share information with other people, such as when you submit a feedback, refer a friend to Cocolime

-        Enable features to personalise your Cocolime account, such as creating bookmarks and preferences for your favourite brands, and to enable quick access to previous destinations.

-        Perform internal operations necessary to provide our Services, including to troubleshoot software bugs and operational problems, to conduct data analysis, testing, and research, and to monitor and analyse usage and activity trends.

     ii.         Safety and security

We use your information to help maintain the safety, security and integrity of our Services and users. This includes, for example:

-        Screening representatives prior to enabling their use of our Services and at subsequent intervals, including thorough reviews of background checks where permitted by law, to prevent use of our Services by unsafe representatives.

-        Using information from representative’s devices to identify unsafe behaviour, such as speeding or harsh braking and acceleration, and raising awareness among representatives regarding such behaviours.

-        ID check feature, which helps ensure that representatives using the application matches the Cocolime account we have on file, preventing fraud and helping to protect other users.

-        Using device, location, profile, usage and other information to prevent, detect, and combat fraud or unsafe activities. This includes processing and analyis of such information to identify practices or patterns that indicate fraud or risk of safety incidents. In certain jurisdictions, this may also involve combining information obtained from third parties. In certain cases, such process may result automated decision-making, including the temporary or permanent deactivation of a user account or restriction of access to our Services if fraudulent or unsafe activity is detected. Users have the right to object to this type of processing, as described under “Special Information for Users,” Section 1(D) below. 

-        Using user ratings to encourage improvement by affected users, and as grounds for deactivating users with ratings below a certain minimum as may be required in their region. Calculation and deactivation may be done through an automated decision-making process. Users have the right to object to this type of processing; see Special information for users, Section 1, D below for more information.

-        For network and information security, to take steps to protect your information against loss or damage, theft or unauthorized access.

    iii.         Customer support

Cocolime uses the information we collect (including recordings of customer support calls after notice to you and with your consent) to assist you when you contact our customer support services. This includes, for example:

-        Direct your questions to the appropriate customer support person.

-        Investigate and address your concerns.

-        Monitor and improve our customer support response.

-        Check that our records are and remain accurate and up-to-date and check that you are satisfied with our Services (e.g. customer research activities carried out by us or agencies on our behalf such as interview, surveys and observations).

    iv.         Research and development

We may use the information we collect for testing, research, analysis and product development and improvement. This allows us to improve and enhance the safety and security of our Services, develop new features, products and services, determine the effectiveness of our sales, marketing and advertising; and analyze and improve our products, services offers, promotions, and website and other technologies.

      v.         Communications among users

Cocolime uses the information we collect to enable communications between our users and with Cocolime, including delivery updates, support messages, or service notifications and for example, a representative may text or call a consumer to confirm information about their order.

    vi.         Communications from Cocolime

Cocolime may use the information we collect to:

-        Communicate with you for marketing purposes about products, services, promotions, studies, surveys, news, updates, events, loyalty programs, or contests, including communicating with participants and awarding prizes. This includes communicating promotional information about us, our partners and our websites, through newsletters and re-marketing ads. This is subject to whether you have expressly opted out of receiving such communications (please see the section headed ‘Contacting Us and Opting Out of Certain Communications’ for more information).

-        Promote and process contests, fulfil any related awards, and serve you relevant ads and content about our services and those of our business partners. You may receive some of these communications based on your profile as a Cocolime user. Users have the right to expressly object to this type of processing; see Contacting Us and Opting Out of Certain Communications Section Cocolime below for more information.

-        Offer a Live Chat feature to assist you with queries you may have. Where available we may record and store chat conversations and calls. These transcripts and call-recordings are only accessed for quality assurance and training purposes.

   vii.         Legal obligations, proceedings and requirements

We may use the information we collect to investigate or address legal obligations, claims or disputes relating to your use of Cocolime services, or as otherwise allowed by applicable law, or as requested by regulators, government entities and official inquiries.

7.     INFORMATION SHARING AND DISCLOSURE

Some of Cocolime products, services and features require that we share information with other users or at your request. We may also share your information with our service providers, affiliates, representatives, subsidiaries and business partners, for legal reasons or in connection with claims or disputes.

We share personal data with third parties when necessary for the purposes described in this Privacy Policy and subject to appropriate safeguards.

Cocolime may share the information we collect:

(i)    With other users

a.      For example, if you are a consumer, we may share your first name and address with representatives.

b.     If you are a representative, we may share information with the consumer(s) including name and photo; vehicle make, model, colour, licence plate and vehicle photo; location; and contact information.

(ii)   At your request

This includes sharing your information with:

a.      Other people at your request.

b.     Cocolime business partners. For example, if you requested a service through a partnership or promotional offering made by a third party, Cocolime may share your information with those third parties. This may also include, for example, other apps or websites that integrate with our APIs, vehicle suppliers, or services, or those with an API or service with which we integrate, or business partners with whom Cocolime may partner with to deliver a promotion, a contest or a specialised service.

(iii)  With the general public when you submit content to a public forum

We love to hear from our users including through public forums such as Cocolime blogs, social media and certain features on our network. Please note that any information or content you share through these public channels may be visible to the public and may be collected or used by others outside of our control. By choosing to communicate or post publicly, you acknowledge that such communications are not private, and Cocolime is not responsible for the security, privacy, or accuracy of any information you choose to make public.

(iv)  WithCocolime subsidiaries, affiliates and group entities

We share information with our subsidiaries, affiliates and group entities to help us provide, improve and support our Services or conduct data processing on our behalf. 

(v)   With Cocolime service providers and business partners

Cocolime may provide information to its vendors, consultants, marketing partners, research firms and other service providers or business partners. This may include, for example:

a.      Payment processors and facilitators.

b.     Background check providers.

c.      Cloud storage providers.

d.     Marketing partners and marketing platform providers.

e.      Data analytics providers.

f.      Research partners, including those performing surveys or research projects in partnership with Cocolime or on Cocolime behalf.

g.     Vendors that assist Cocolime to enhance the safety and security of its application.

h.     Consultants, lawyers, accountants and other professional service providers.

i.       Fleet partners.

j.       Insurance and finance partners.

k.     Airports.

l.       Vehicle solution vendors or third-party vehicle suppliers.

(vi)  For legal reasons and/or in the event of a dispute

Cocolime may share your information if we believe it is required by applicable law, regulation, operating agreement, legal process or governmental request, or where the disclosure is otherwise appropriate due to safety or similar concerns.

This includes sharing your information with law enforcement officials, government authorities, regulators, airports (if required by the airport authorities as a condition of operating on airport property or if otherwise required), and/or other third parties as necessary to enforce our Terms and Conditions/Term of Service, user agreements, or other policies, or to protect the rights, property, safety of Cocolime, its users or the public; and/or in the event of a claim, investigation or dispute relating to your use of our Services. If you use another person’s payment method or credit card, we may be required by law to share information with that credit card holder or relevant financial institution, including trip information.

We may also share your information with others in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, acquisition of all or a portion of our business by or into another company or similar business transaction.

(vii) With your consent

Cocolime may share your information other than as described in this Privacy Policy provided we notify you and you consent to the sharing.

8.     INFORMATION RETENTION AND DELETION

8.1.  Cocolime retains personal information for as long as necessary to fulfill the purposes for which it was collected, including to provide our Services, comply with legal, regulatory, and tax obligations, resolve disputes, and enforce our agreements.

8.2.  When retention is required by law, access to such data is restricted and it is used only for those specific legal purposes.

8.3.           Cocolime retains user profile and other information for as long as you maintain your Cocolime account.

8.4.           Cocolime retains certain information including transaction, location, usage and other information for a minimum of 7 years, or as otherwise required under regulatory, tax, insurance or other legal requirements in the jurisdictions in which we operate. Thereafter, once such information is no longer necessary to provide Cocolime’s Services, enable customer support, enhance the user experience or for other operational purposes, such information is deleted or anonymized in accordance with applicable laws. Notwithstanding the foregoing, certain information may be retained beyond the standard retention period where required to comply with record-keeping, dispute resolution, fraud prevention, or legal hold obligations.

8.5.           Notwithstanding anything to the contrary, Cocolime may also retain certain information if necessary for its legitimate business interests, such as fraud prevention and enhancing users' safety and security. For example, if Cocolime shuts down a user's account because of unsafe behaviour or security incidents, Cocolime may retain certain information about that account to prevent that user from opening a new Cocolime account in the future.

8.6.           Users may request deletion of their accounts at any time within the Cocolime application by tapping on More > User’s Profile > Delete Account, and by emailing us at privacypolicyandcookiestatement@cocolime.com.

8.7.           Upon receiving a valid deletion request, Cocolime will delete or anonymize the information that it is not required to retain under applicable laws, and will restrict access to or use of any information it is required to retain for legal, regulatory, or legitimate business reasons.

8.8.           In certain circumstances, Cocolime may be unable to delete your account, such as if there is an outstanding credit on your account or an unresolved claim or dispute. Upon resolution of the issue preventing deletion, Cocolime will delete or anonymize your account as described above. 

9.     SPECIAL INFORMATION FOR USERS

This section summarizes Cocolime’s grounds for processing personal information and the rights of users in connection with Cocolime’s handling of personal information.

       i.         User rights

Before providing personal information to you or another person authorized to act on your behalf, we may require proof of identity and sufficient information/details about your interactions with us so that we can locate your relevant personal information.

Except in exceptional cases or where a longer period is permitted by law, we will respond to you within 30 days from the date we receive all required information to process your request  (or, where no such information is required, within thirty (30) days of receiving the request itself). If we are unable to act on your request, we will notify you in writing and explain the legal or operational reasons for our decision.

If you are a Cocolime User, you have the following rights with respect to Cocolime’s handling of your personal information. To exercise these rights, please see below and submit your request to Cocolime.  

A.    Explanation and copies of your data

-        You have the right to request an explanation of the information that Cocolime has about you and how Cocolime uses that information.

-        You also have the right to request a copy of the information that Cocolime has collected about you, where such information has been collected on the basis of consent or because it is necessary for the provision of the services you have requested.

-        In responding to such requests, Cocolime may take reasonable steps to verify your identity and confirm the scope of your request before providing access to or copies of any personal data.

B.     Correction

If Cocolime has information about you that you believe is inaccurate, you have the right to request correction of your information.

C.    Deletion

Subject to the other provisions in this Privacy Policy regarding deletion, Users may request deletion of their accounts at any time by emailing us at the email address set out above. We may retain certain information about you as required by law and for legitimate business purposes permitted by law.

D.    Objections and complaints

Users have the right to object to Cocolime’s processing of their personal data, including for marketing purposes based on profiling and/or automated decision-making. Upon receiving an objection, Cocolime will review and assess the request in accordance with this Privacy Policy and applicable data-protection laws. However, Cocolime may continue to process personal information to the extent that such processing is lawful or otherwise permitted under applicable regulations..

     ii.         Grounds for processing

Cocolime processes the information of users based on one or more of the grounds below, noting that Cocolime only process personal data when necessary for specific, legitimate, and explicit purposes, and based on a valid legal basis, including contract performance, legal obligations, vital interests, legitimate interests, or your consent where required. Certain data elements may be mandatory to provide the Services, while others are optional.

A.    This processing is necessary to provide the services and features you request

Cocolime must collect and use certain information in order to provide its services. This includes:

-        User profile information that is necessary to establish and maintain your account, including to verify your identity; enable communications with you about your trips, orders and accounts; and to enable you to make or receive payments.

-        Background check information necessary to enable representatives to provide delivery services through the Cocolime application.

-        Representative location information, which is necessary to match representatives with consumers and to track trips while in progress.

-        Transaction information, which is necessary to generate and maintain in connection with your use of Cocolime’s services.

-        Usage information, which is necessary to maintain, optimise and enhance Cocolime services, including to determine, sometimes in combination with other information, incentives, connect consumers and representatives, and calculate costs of trips and representative payments.

-        Collection and use of this information is a requirement for using Cocolime apps.

B.     The processing is necessary to protect the vital interests of our Users or of other individuals

Cocolime may process personal information, including disclosing data to law enforcement authorities in case of threats to the safety of users or of other individuals.

C.    The processing is necessary forCocolime’s legitimate interests

Cocolime collects and uses personal information to the extent necessary for its legitimate interests. This includes collecting and using information:

-        Maintain and enhance our Users' safety and security. For example, we collect background check information (where permitted by law) to prevent unsafe users from providing services through our apps. We also use personal information to prevent use of our services by users who have engaged in inappropriate or dangerous behaviour, such as by retaining information of banned users to prevent their use of Cocolime’s apps. We also use usage information to prevent matching of consumers and representatives for whom there is higher risk of conflict (e.g. because they have been the subject of prior complaints from other users).

-        Prevent, detect and combat fraud in connection with the use of our services. For example, Cocolime uses user profile, location, device and usage information to identify and prevent circumstances when users attempt to defraud Cocolime or other users.

-        Inform law enforcement officials regarding criminal acts or threats to public safety.

-        Provide customer support.

-        Optimise our Services and develop new services. This includes, for example, identifying the best drop-off locations, recommending (new) features, improving navigation, enhancing pricing and matching consumers and representatives.

-        For research and analytical purposes. This includes, for example, analysing usage trends to improve the user experience and enhance the safety and security of our services.

-        For direct marketing purposes. This includes, for example, analysing data to identify trends and tailor marketing messages to user needs.

-        To enforce Cocolime’s Terms of Service.

D.    The processing is necessary for the legitimate interests of other persons or parties

-        Cocolime collects and uses personal information to the extent necessary for the interests of other persons or the general public. This includes sharing information in connection with legal or insurance claims, to protect the rights and safety of others.

-        Cocolime may also process personal information when necessary in regard to a substantial public interest, on the basis of applicable laws.

E.     The processing is necessary to fulfil Cocolime legal obligations

-        Cocolime is subject to legal requirements in the jurisdictions in which it operates that require us to collect, process, disclose and retain your personal data. Cocolime uses your information to comply with such laws to the extent they apply to your use of the Cocolime apps.

-        Cocolime may also share information with law enforcement, or requests by third parties pursuant to legal processes. For more information about such sharing.

F.     Consent

-        Cocolime may collect and use your information on the basis of your consent. You may revoke your consent at any time. If you revoke your consent, you will not be able to use any Service or feature that requires collection or use of the information we collected or used on the basis of consent.

-        Cocolime relies on consent in connection with data collections or uses that are necessary to enhance the user experience, to enable optional services or features, or to communicate with you. The following types of data are collected or used on the basis of user consent.

-        Location information (consumers)

-        Share live location (consumers)

-        Notifications: Account and delivery trip updates

-        Notifications: Discounts and news

-        Address book/contacts

-        Calendar syncing

-        Accessibility features

-        Cocolime may also collect personal information about you through voluntary surveys. Your responses to such surveys are collected on the basis of consent and will be deleted once no longer necessary for the purposes collected.

10.   CHOICE AND TRANSPARENCY

10.1.  Cocolime provides means for you to see and control the information that Cocolime collects, including through:

-        in-app privacy settings

-        device permissions

-        in-app ratings pages

-        marketing opt-outs

10.2.   You may also request that Cocolime provide you with explanation, copies or correction of your data.

10.3.        The privacy prompts in the Cocolime app gives users the ability to set their location and contact sharing preferences, and their preferences for receiving mobile notifications from Cocolime Information on these settings, how to set or change these settings, and the effect of turning off these settings is described below.

11.   MARKETING OPT-OUTS

Marketing communications are sent only if permitted by applicable law and do not involve the use of sensitive personal data. You may withdraw your consent at any time and opt out of receiving promotional emails from Cocolime by submitting a request by email to Cocolime You may also opt out of receiving emails and other messages from Cocolime by following the instructions in those messages.

Please note that if you opt out, we may still send you non-promotional messages, such as receipts for your purchases or information about your account.

12.   INTERNATIONAL TRANSFERS OF PERSONAL DATA

From time-to-time we may also transfer your personal information (for example, to our suppliers, service providers or other companies within our group) out of the territory in which the data was collected and also outside of the Kingdom of Saudi Arabia for the purposes described in this Privacy Policy.

Unless otherwise allowed by data protection laws, where we transfer information to a country not recognised by the regulator as having adequate levels of protection, we will put in place appropriate safeguards to ensure your information is protected in the same way as if it was being used in the territory in which it was collected. This can include putting in place contractual protections (known as standard contractual clauses) and other organisational or technical measures designed to safeguard information. We require all third parties to whom any personal data is disclosed to keep it secure, treat it as confidential and use it only for the purposes agreed with us. In submitting your data to us and using our application you acknowledge and agree to the international transfer of your information in line with this Privacy Policy.

13.   COOKIES

Our application uses first party cookies (very small files that are sent by us to your computer or other access device) and other similar technologies which we can access when you visit our application in the future. We may also use third party cookies.

There are five types of cookies:

(i)             Application Functionality Cookies

These cookies enable you to browse the application and use our features such as shopping baskets.

(ii)            Application Analytics Cookies

We use these cookies to measure and analyze how our customers use the application. This allows us to continuously improve our application and your shopping experience.

(iii)           Customer Preference Cookies

When browsing or shopping online, the application will remember your preferences (for example your user name, language or location). This makes your browsing experience simpler, easier and more personal to you.

(iv)           Targeting Cookies or Advertising Cookies

These cookies are used to deliver adverts relevant to you. In addition, they limit the number of times you see an advertisement as well as helping us measure the effectiveness of our advertising campaigns.

(v)            Third-Party Service Provider Cookies

We may work with third party companies whom we authorize to place third-party cookies, web beacons, or similar technologies for storing information on the application. These service providers help us to provide you with a better, faster, and safer experience and may use these technologies in the ways described above and in addition may help us and you to avoid fraud. By using our application you agree that we and they can place these types of cookies on your device and access them whenever you visit the application or other websites operated by us. If you want to delete any cookies that are already on your computer, please refer to the help and support area on your internet browser for instructions on how to locate the file or directory that stores cookies. 16.1.  This Privacy Policy shall be governed and construed in accordance with the laws of the Kingdom of Saudi Arabia.

If such dispute, controversy or claim is not resolved within sixty (60) days, it shall be referred to the Saudi Center for Commercial Arbitration (the “Center”) for mediation in accordance with the Center’s applicable rules.

16.3.  If mediation does not result in a settlement within thirty (30) days from the date of referral to the Center, the dispute shall be finally and exclusively resolved by arbitration under the Center’s rules. The arbitral tribunal shall consist of a sole arbitrator appointed in accordance with such rules. The seat of arbitration shall be Riyadh, Kingdom of Saudi Arabia, and the language of proceedings shall be Arabic.

16.4.  All amicable discussions, mediation and arbitration proceedings, including submissions, documents, and awards, and all related materials shall remain strictly confidential and may not be disclosed to any third party except as required by law or for the enforcement of an arbitral award.
